Navigating the complexities of immigration law can be daunting for individuals and businesses. Understanding the ins and outs of the legal system can be overwhelming, but with the right guidance and support, the process can be much more manageable.

Seeking Asylum in the US: Safety and a New Life

Thousands apply for asylum in the US every year, escaping persecution based on protected grounds such as race, religion, nationality, or social/political affiliation.

What is Asylum?

Asylum is a legal means by which people who fear persecution in their home country can obtain legal status in the U.S. Asylees can work, obtain a Social Security card, travel, and petition for certain family members to join them. After one year, they may apply for a green card and later, if eligible, for U.S. citizenship.

Who is Eligible?

You may be eligible if you are outside the US seeking entry or are already present. You must demonstrate a well-founded fear of persecution in your home country. The fear may be based on threats of violence, human rights abuses, or other harm, specifically at the hands of government actors or by private actors whom the government has failed to control.

The Application Process: Complex but Navigable

There are three main ways to apply for asylum: Affirmative (which consists of an interview with USCIS), Defensive (for those in removal proceedings and who are using asylum as a defense against deportation before the immigration court, and Expedited. Each has specific requirements and deadlines. The process can be complex and time-consuming, and mistakes can jeopardize your case.
